A. Nathan Brickwork Terms and Conditions
1. General Terms
- All designs created on paper or by computer by A Nathan Brickwork shall remain the property of A Nathan Brickwork.
- All visitors to the site where works are being carried out, including property owners, do so at their own risk. A Nathan Brickwork will not accept liability for injury should an accident occur.
- Where special-order or non-refundable materials are required, the full cost of those items will be payable before the start of the job.
- The client confirms and accepts responsibility for obtaining all relevant planning permission, building control approval, party wall approvals and confirmation of boundary ownership.
- It is the client's responsibility, under current legislation, to inform adjacent property owners of the nature of any proposed works and the intended commencement dates.
- For quotations over £5,000.00, a written JCT contract will be set up between A Nathan Brickwork and the client.
- Any extras, alterations to the quoted works, or changes to materials requested by the client will be subject to additional charges based on a day-rate basis, together with any additional material costs. A separate quotation will be provided for each additional change and must be accepted in writing before the work is carried out or materials are purchased.
2. Access, Site Conditions & Working Hours
- The client, by accepting the quotation, agrees to A Nathan Brickwork carrying out the described works at the property. The client shall make reasonable provision to protect fixtures, fittings and possessions not included within the described works, and shall provide safe, suitable and uninterrupted access.
- Once the quotation is accepted and a commencement date is agreed, it is assumed that water, electricity and toilet facilities will be available for use by all workmen on site. If these facilities are not available, an additional charge may be made to provide suitable services in accordance with health and safety requirements.
- Quoted prices are calculated on the basis of free access and unimpeded working during normal working hours of 8:00am–4:30pm, Monday to Friday, unless otherwise agreed. We may occasionally need to work until 6:00pm or on a Saturday; prior agreement with the client will be sought.
- Timescales are based on continual access and the planned scheduling of works. All timescales are estimates and may be affected by material availability, weather conditions and labour availability. Liability cannot be accepted for delays or their effects arising from causes outside our control.
3. Quotations, Materials & Variations
- The quotation is based on known material and other costs at the time it is prepared. Due to ongoing price increases within the building trade, A Nathan Brickwork may need to increase charges where supplier or material costs increase. The client will be notified of any such increase.
- The quotation will remain open for acceptance for three months from the quotation date.
- Skips provided on site are for the sole use of A Nathan Brickwork only.
- Materials purchased by A Nathan Brickwork on behalf of the client cannot be changed without the applicable restocking charge. Where a change is required, the client should contact A Nathan Brickwork as soon as possible to help avoid additional charges.
4. Insurance & Payment
- A Nathan Brickwork holds Public Liability Insurance to the sum of £3,000,000. All usual general building practices are covered within our insurance policy.
- The outstanding balance must be settled in full within 5 working days from the date shown on the invoice, unless stage payments have been agreed.
- If payments are late, work will be suspended until overdue payments are received. Late payments will be subject to a £25 late fee plus interest at 5% above the Bank of England base rate, calculated weekly.
- All materials and goods supplied by A Nathan Brickwork shall remain the property of A Nathan Brickwork until payment has been received in full.
- Until full and complete payment has been received, A Nathan Brickwork may remove materials and goods from the site. The client shall allow such access to the site as is reasonably necessary for their removal.
5. Cancellations, Termination & Photography
- A minimum of five working days' notice is requested for cancellations or postponements.
- A Nathan Brickwork reserves the right to terminate an agreed contract if the client is in breach of these terms and conditions.
- During each project, A Nathan Brickwork reserves the right to take photographs during the various stages of the work. These photographs are for marketing purposes, with personal details removed.
6. Business & Payment Details
- A Nathan Brickwork is not VAT registered.
- Payment is preferred by BACS.
Key Payment Terms
Outstanding balances are due within 5 working days unless stage payments have been agreed. Late payment may result in work being suspended and the charges described in Clause 18.
7. Client Acceptance
Acceptance of the quotation confirms that the client has read and agrees to these Terms & Conditions and the quotation to which they relate.
